TERMS OF SERVICE

CONTRACTING PARTY AND ACCEPTANCE

These Terms are between you and Wiseman Applied Intelligence LLC ("HEXBIRD", "we", or "us"), the operator of HEXBIRD. You accept these Terms when you check the acceptance box presented at sign-up or checkout, create an account, connect an MCP client, use the HTTP API, or pay for a subscription. If you do not agree to these Terms, do not use HEXBIRD.

You must be at least 18 years old and able to form a binding contract to use HEXBIRD. If you use HEXBIRD on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and "you" refers to that organization.

SERVICE

HEXBIRD provides aviation intelligence tools for research workflows, including browser chat, flight history, safety-event context, aircraft ownership context, airspace context, infrastructure context, MCP access, and HTTP API access depending on your plan.

HEXBIRD may change, limit, suspend, or discontinue parts of the service as data sources, infrastructure, laws, safety needs, or product priorities change.

ACCOUNTS AND ACCESS

You are responsible for activity under your account, API tokens, MCP authorizations, passkeys, and team workspace. Keep credentials secure and revoke tokens you no longer use.

You may not share credentials outside your authorized users, resell access, bypass plan limits, interfere with service operation, or attempt to access data or systems outside the permissions granted to your account.

INTELLECTUAL PROPERTY AND LICENSE

HEXBIRD, including its software, interfaces, data compilations, documentation, and brand, is owned by Wiseman Applied Intelligence LLC and protected by intellectual property laws. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use HEXBIRD for your internal research and business purposes.

You may not copy, modify, reverse engineer, resell, sublicense, or create derivative works of HEXBIRD or its underlying data sources except as expressly permitted by these Terms or applicable law. All rights not expressly granted to you are reserved.

SUBSCRIPTIONS, BILLING, AND RENEWAL

Paid plans are subscription services unless a separate written agreement says otherwise. Prices, included usage, seats, support levels, and API/MCP access are shown on the pricing page or in an applicable order form.

Subscriptions renew automatically for successive periods of the same length until you cancel. By subscribing, you authorize Wiseman Applied Intelligence LLC and its payment processor to charge your payment method, on a recurring basis, the then-current subscription fee, applicable taxes, and any agreed usage-based or add-on fees, until you cancel.

We will give you advance notice of any increase to your recurring fee, and the new price applies to the next renewal after that notice. You may cancel before that renewal if you do not accept the new price. You can cancel at any time through your account settings or by contacting us, as described below.

CANCELLATION, DOWNGRADES, AND REFUNDS

You may cancel a subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period unless a separate written agreement or applicable law requires otherwise. You keep your current paid plan until that period ends.

Downgrades take effect at the end of the current billing period. Until then, the workspace keeps the current plan access, quotas, seats, API/MCP permissions, and retention behavior. At renewal, the workspace moves to the lower plan and any features, seats, quotas, API/MCP access, or retention options not included in that plan are disabled.

After cancellation, the paid subscription ends and the workspace returns to the available free, trial, or manual-access tier unless a separate written agreement says otherwise. Saved investigations and account data remain available subject to the plan then in effect, the Privacy Policy, security needs, legal obligations, abuse prevention, and service-retention limits.

Refunds are not automatic after a paid billing period starts or after the service has been used. Refund requests are reviewed case by case unless a refund is required by law or promised in a separate written agreement. If a billing error occurs, contact us promptly so it can be reviewed and corrected.

ACCEPTABLE USE

You may use HEXBIRD for lawful aviation, geospatial, journalistic, research, operational-analysis, compliance, and similar intelligence workflows.

You may not use HEXBIRD to harass, stalk, threaten, dox, unlawfully surveil, evade law enforcement restrictions, target private persons for harm, overload the service, scrape beyond authorized interfaces, bypass usage controls, or assist unlawful activity.

These acceptable-use rules apply now and are supplemented by the public Acceptable Use Policy.

API AND MCP USE

API and MCP access are available only on plans or agreements that include them. You must not use automated access to avoid quotas, hide abusive traffic, defeat metering, perform unauthorized bulk extraction, or degrade the service for others.

The operator may throttle, suspend, revoke, or require changes to API/MCP access if usage creates security, reliability, cost, legal, or safety risk.

DATA LIMITATIONS

HEXBIRD depends on third-party and public data sources. Data may be delayed, incomplete, inaccurate, unavailable, misassociated, or changed after HEXBIRD processes it.

HEXBIRD is not an official FAA, ATC, dispatch, emergency-response, aircraft-separation, or safety-of-life system. Do not use HEXBIRD as the sole basis for real-time operational decisions, emergency response, aircraft control, navigation, or safety-critical action.

USER CONTENT, OUTPUT, AND FEEDBACK

You are responsible for prompts, uploads, queries, reports, exports, and other content you submit or generate through HEXBIRD. You must have the rights needed to submit that content and use the resulting output.

HEXBIRD may log prompts, API requests, tool calls, query statistics, account activity, and generated output to provide the service, enforce limits, debug issues, improve reliability, and protect the platform. Our handling of personal data is described in the Privacy Policy.

If you send us feedback or suggestions about HEXBIRD, you grant Wiseman Applied Intelligence LLC a perpetual, irrevocable, royalty-free license to use them without restriction or any obligation to you.

EXPORT CONTROL AND SANCTIONS

You must comply with all applicable export control, sanctions, and trade laws in connection with your use of HEXBIRD. You represent that you are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive sanctions, that you are not a party identified on any applicable restricted or denied-party list, and that you will not use HEXBIRD for any purpose prohibited by those laws.

SUSPENSION AND TERMINATION

Wiseman Applied Intelligence LLC may suspend or terminate accounts, workspaces, tokens, API access, MCP access, or subscriptions for nonpayment, security risk, misuse, violation of these Terms, legal risk, or service integrity reasons.

You may stop using HEXBIRD at any time. Some records may be retained as needed for billing, security, audit logs, legal obligations, abuse prevention, and service operation.

Provisions that by their nature should survive termination will survive, including Intellectual Property and License, Warranty Disclaimer, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and General.

WARRANTY DISCLAIMER

HEXBIRD is provided as is and as available. To the fullest extent permitted by law, Wiseman Applied Intelligence LLC disclaims warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, non-infringement, and error-free operation.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Wiseman Applied Intelligence LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or substitute services.

To the fullest extent permitted by law, Wiseman Applied Intelligence LLC total liability for claims related to HEXBIRD is limited to the amount you paid for HEXBIRD during the three months before the event giving rise to the claim.

INDEMNIFICATION

You will defend, indemnify, and hold harmless Wiseman Applied Intelligence LLC and its members, officers, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of HEXBIRD, your content, your violation of these Terms or applicable law, or your infringement of any third party’s rights. We may assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of Delaware, without regard to conflict-of-law rules, unless a separate written agreement says otherwise or applicable law requires a different rule.

Except where prohibited by applicable law, the state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of or relating to these Terms or HEXBIRD, and you consent to personal jurisdiction and venue in those courts.

To the fullest extent permitted by law, each party waives any right to a jury trial, and any claim relating to HEXBIRD must be brought within one year after the claim arises or it is permanently barred.

CHANGES TO THESE TERMS

Wiseman Applied Intelligence LLC may update these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, provide notice through the service or by email and, where appropriate, ask you to accept the updated Terms. Changes take effect when posted unless stated otherwise, and your continued use after they take effect means you accept the updated Terms.

GENERAL

These Terms, together with any order form, plan terms, and policies referenced here, are the entire agreement between you and Wiseman Applied Intelligence LLC regarding HEXBIRD and supersede any prior agreements on that subject. If there is a conflict, a signed written agreement controls over an order form, which controls over these Terms.

If any provision of these Terms is held unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it.

You may not assign these Terms without our prior written consent. We may assign them, including in connection with a merger, acquisition, or sale of assets. These Terms bind and benefit the parties and their permitted successors and assigns.

Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control, such as natural disasters, outages, network or infrastructure failures, labor disputes, or government actions.
